This website, along with our various mobile applications and social media pages (collectively, the “Platforms”) are owned and operated by American Family Mutual Insurance Company, S.I. or its affiliates (“American Family,” “we,” “our,” or “us”). These Terms and Conditions (the “Terms”) and our Privacy Policy (the “Privacy Policy”) govern your access to the Platforms. By downloading, installing, accessing or using our Platforms, you agree to be bound by these Terms and the Privacy Policy. If you do not agree with these Terms or the Privacy Policy, you should refrain from downloading, installing, accessing or using our Platforms immediately.

 

We may change, update, add, or remove provisions of these Terms at any time by posting the updated terms on the Platforms. By using the Platforms after we have updated the Terms, you are agreeing to the then-current Terms.

 

Accessing the platforms

 

We reserve the right to change, withdraw or update Platforms in our sole discretion without notice. The Platforms may be unavailable at any time or for any period. From time to time, in our sole discretion and without notice, we may restrict access to some or all of the Platforms.

You are responsible for making all arrangements necessary for you to have access to the Platforms and ensuring that all persons who access the Platforms through your internet connection or devices are aware of these Terms and the Privacy Policy and comply with them.

If you are below the age of 18, you may download, install, access or use our Platforms only under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

 

Access to password protected/secure areas

To access the Platforms or some of the resources they offer, you may be asked to provide certain registration details or other information. It is a condition of your use of the Platforms that all the information you provide on the Platforms is correct, current, and complete.

If you choose, or are provided with, a user ID, password, or any other piece of information as part of our security procedures (your “Credentials”), you must treat your Credentials as confidential, and you must not disclose them to any other person or entity. You agree that we are entitled to act on instructions received under your Credentials. You agree to notify us immediately of any unauthorized access to or use of your Credentials or any other breach of security. You agree to update us with any changes to your contact information. You also agree to ensure that you exit from your account at the end of each session and be particularly cautious when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information.

We reserve all rights with respect to unauthorized access to the Platforms. We have the right to disable any of your Credentials at any time in our sole discretion for any reason, including if, in our opinion, you have violated any provision of these Terms. American Family is not liable for any loss or damage arising from your failure to comply with this section of the Terms.

 

Proprietary rights and your use of the platforms

Unless otherwise specified in these Terms, all information and screens appearing on the Platforms are the sole, copyrighted and/or trademarked, property of American Family, our subsidiaries or affiliates, or our third-party licensors and subscribers (collectively, the “Content”). Content may include documents, services, software, site design, text, graphics, logos, video, images, icons, and other content, as well as the arrangement thereof.

Subject to these Terms, we hereby grant you a limited, personal, non-exclusive and non-transferable license to use, view, print, display and download the Content for the sole purpose of viewing it on a stand-alone personal computer or mobile device and to use the Platforms solely for your personal use. Except for the foregoing license and as otherwise required or limited by applicable law, you have no other rights in the Platforms or any Content and you may not modify, edit, copy, reproduce, create derivative works of, reverse engineer, alter, enhance or in any way exploit any of the Platforms or Content in any manner or for any purpose that would constitute infringement of intellectual property rights of us, our licensors, or other users. All rights not expressly granted herein are reserved.

If you breach any of these Terms, you are responsible for any damages that result from your infringement of intellectual property rights and the above license will terminate automatically.

 

Products and services

Products and services offered vary by state, purchase channel, and underwriting company. All products are not available in all states, and our products and services are generally not available outside the United States.

The Content is informational only. Nothing on our Platforms shall be interpreted as an offer for the sale of any insurance product to you, an agreement to provide insurance coverage, a resolution of any claim, or any offer to provide any services in any jurisdiction where we do not do business. Your eligibility to purchase our products is subject to your application and review and qualification by American Family in its sole discretion. Claims are subject to verification and requests for information, as well as coverage determinations, and the specific terms of your insurance policy. The Content and Terms do not modify or supplement any insurance policy you may have purchased from us.

 

Your communications to the platforms

By communicating feedback about or content to the Platforms, you thereby grant us a perpetual, royalty-free, world-wide, irrevocable, nonexclusive license to use, reproduce, modify, adapt, publish, translate, create derivative works from, redistribute, and display such content and communications in any form for any purpose. No compensation will be paid to you with respect to our use of your communications or content. By providing or submitting information, you represent and warrant that you own or otherwise control all the rights necessary for you to submit the information and grant the license above.

 

Electronic communications

By using the Platforms and/or the Platforms, you warrant that the information that you provide to us is accurate and up to date, including your email and telephone numbers. You also consent to receiving electronic communications from us. These electronic communications may include notices about applicable fees and charges, emails, transactional information and other information concerning or related to the Platforms. You agree that any notices, agreements, disclosures or other communications that we send you electronically will satisfy any legal communication requirements, including that such communications be in writing. You are responsible for having a device and software that is able to save and/or print such communications. To the extent that you submit information to us that requires your electronic signature, you may be asked to agree to additional terms regarding your electronic signature.

Although the Platforms are available via your mobile device, delivery of information and content to or from your equipment/mobile device may fail due to a variety of circumstances or conditions that are outside of American Family’s control. We cannot guarantee that information sent through the internet is secure, and emails to and from American Family are generally not encrypted and cannot be relied upon to communicate privately or securely with us. All sensitive or confidential information should be communicated to us through our online service website (My Account) and mobile app (MyAmFam app) which are restricted and require a user identification code (User ID) and a password for access.

If you no longer wish to receive marketing or promotional emails from American Family, please click the unsubscribe link included in these emails. We may continue to send transactional email messages for service and support related to our insurance products that you have purchased, if applicable.

To the extent that you have authorized American Family to send you text messages, which may or may not require separately-provided consent by you, for claims services, quotation, or otherwise, note that message and data rates may apply from your mobile carrier. By providing your consent to participate in texting with American Family, the account holder approves any such charges from their mobile carrier. If you no longer wish to receive text messages from American Family, respond to a text with “STOP.”

 

Permitted uses

Unauthorized use of the Platforms is prohibited. You must use the Platforms for lawful purposes only. You may not, and you may not authorize, encourage, or support a third party’s attempts to, use the Platforms in any way that is unlawful or that:

  • Damages, disrupts, overburdens, interferes, or impairs the Platforms or American Family’s servers or networks or attempts to gain unauthorized access to our networks;
  • Systematically retrieves data or Content on the Platforms or uses any process that indexes, scrapes, data mines, or otherwise gathers, copies, or redistributes any Content or email addresses from the Platform;
  • Changes, alters, or impairs the Platforms or Content; copies, reproduces, modifies, creates derivative works from, distributes or publicly displays the Platforms or Content unless as permitted in writing by us or in accordance with these Terms;
  • Interferes with or induces a breach of the contractual relationships between us and any third party or our employees;
  • Is harmful or destructive to anyone or their property;
  • Transmits any advertisements, solicitations, schemes, spam, flooding, or other unsolicited email or commercial communications;
  • Solicits any users of the Platforms, via email, text, image, video or any other method;
  • Suggests an express or implied affiliation or relationship with us without our express written permission or otherwise misrepresents your affiliation with us;
  • Impairs or limits our ability to operate the Platforms or any other person’s ability to access and use the Platforms;
  • Dilutes or depreciates our or any of our affiliates’ name and reputation;
  • Transmits or uploads content or images that infringe upon any third party’s intellectual property rights or right to privacy; uploads violent, obscene, sexually explicit, false, misleading, discriminatory, hateful, threatening, abusive, defamatory, obscene, offensive, harassing, or otherwise objectionable or discriminatory content or images; or uploads any confidential, proprietary or trade secret information;
  • Circumvents user authentication or security of any user, host, network or account; or
  • Bypasses any robot exclusion headers or other measures we may use to prevent or restrict access to our Platforms.
 

This list of prohibited activities provides examples and is not complete or exclusive. We reserve the right to terminate access to your account and your ability to use the Platforms (or the Content) with or without cause and with or without notice, for any reason or no reason, or for any action that we determine is inappropriate or disruptive to the Platforms or to any other user of the Platforms and/or Content. We may report to law enforcement authorities any actions that may be illegal.

 

Third-party links and information

We may provide links to other third-party websites through the Platforms solely as a convenience to you. However, such linking does not mean, and should not be interpreted to mean, that we endorse, are affiliated with or make any representations concerning such third-party websites. We do not review, do not control, and are not responsible for these third-party sites or any content therein. By using such links, you will leave the Platforms. Please note that any information that you provide to such third parties will be governed by their terms of service and privacy policies, and we have no control over or responsibility for their terms or privacy practices. If you decide to access any of the third-party sites linked to the Platforms, you do so entirely at your own risk. We shall not be liable for any consequences arising from use of any third-party websites.

 

Consent to monitoring of activity on the platforms

Every time you come to our Platforms, our Platforms’ servers automatically collect information, including, in some instances, your personal information, through cookies, web beacons, pixels, and other similar tracking technologies (collectively “cookies”). Our website also uses virtual assistants and session replay technology.

Cookies. Please see our cookies policy for more information about cookies and how we use them.

Marketing pixels. A marketing pixel (also called a tracking pixel or pixel tag) is a tiny, invisible piece of code added to a website or email. It tracks user behavior like visits, clicks, or conversions, for measurement and/or to build target audiences.

Web chat. We log user conversations with our chatbot to provide customer support to you. Our chatbot is administered by one of our service providers. When you type information into the chat, messages may be recorded and/or transcribed for record keeping and other purposes.

Session replay technology. We use a specific type of analytics tool called “session replay technology.” Session replay technology enhances user experience by optimizing the efficiency, design and quality of the Services. By using session replay technology, we can collect and analyze information related to user behavioral metrics on the Platforms, such as mouse movements, clicks, user inputs, scrolling, access times, visit duration, pages viewed, IP address (including approximate location), operating system, and page reloading. These tools provide insight into what works and what doesn’t work for website visitors, and they allow us to, for example, identify and repair technical errors such as broken links that impair the Platforms’ functionality.


Your access and use of the Platforms constitutes consent to the monitoring set forth herein, and the disclosure and use of such information. If you do not consent to the monitoring described here, you should not use the Platforms.

 

Linking to the platforms and social media features

You may not use any meta tags or any other “hidden text” utilizing our name or trademarks, or provide links to or frame our Platforms, without our prior written permission, which may be withheld or withdrawn in our sole discretion.

 

Federal and state laws

The Platforms are designed for residents of the United States only and should not be considered a solicitation to buy or an offer to sell products and services in any other jurisdiction. The Platforms are operated from the United States and are not approved for distribution outside of the U.S. and non-U.S. residents should not rely or act upon the information contained within. When using the Platforms or when using any Content, you must obey all applicable U.S. federal, state and local laws and regulations.

 

Information posted as is; other agreements

We do not warrant the accuracy, completeness, or usefulness of the Content or the Platforms and your use of the Platforms and Content is strictly at your own risk. The Content and Platforms are provided to you “as is” for informational purposes only. We do not make any promises or guarantees based on this information. Your use of certain features of the Platforms may be governed by additional legal notices, or terms and conditions that govern those specific features.

The Content and Platforms may include brief descriptions of coverages, are not part of your insurance policy, and are not promises or guarantees of coverage. If there is any conflict between this information and your policy, the provisions of the policy will prevail. Insurance policy terms and conditions may apply. Coverage features and limits vary by state and may be subject to change. Some products are not available in every state. Discount availability and eligibility vary by state and policy terms. AMERICAN FAMILY DOES NOT WARRANT OR REPRESENT THAT THE FUNCTIONS OR OPERATION OF THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES, SERVERS OR ANY EMAIL SENT FROM AMERICAN FAMILY ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS OR THAT THE SERVICES WILL REMAIN AVAILABLE TO YOU.

 

Limitation of liability

YOU AGREE THAT EITHER WE NOR OUR AFFILIATES, EMPLOYEES, AGENTS, OFFICERS, DIRECTORS, OR REPRESENTATIVES (THE “AMFAM PARTIES”) WILL BE LIABLE FOR ANY DAMAGES, WHETHER THEY ARE DIRECT, PUNITIVE, SPECIAL, CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES (INCLUDING WITHOUT LIMITATION LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF PROGRAMS OR OTHER DATA, COST OF PROCURING SUBSTITUTE SERVICE OR LOST OPPORTUNITY) ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE PLATFORMS, CONTENT OR ANY LINKED SITE, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES WHETHER BASED ON WARRANTY, CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE EVEN IF WE ARE EXPRESSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

 

Indemnification

You agree to indemnify, defend and hold harmless the AmFam Parties from and against any and all claims, demands, actions, liability, fines, penalties and expenses that may arise from any of your use of the Platforms or Content or your breach of any provision of these Terms.

 

Copyright complaints

If you believe that your work has been copied on the Platforms in a way that constitutes copyright infringement, please provide our copyright agent with the following information.

  • Description of the copyrighted work that you claim has been infringed;
  • The location on the Platforms of the material that you claim is infringing;
  • Your address, telephone number and e-mail address;
  • A statement made under penalty of perjury that the information you have provided is in good faith, accurate, and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

Arbitration and class action waiver

YOU AGREE THAT ALL DISPUTES BETWEEN YOU AND US (WHETHER OR NOT SUCH DISPUTE INVOLVES A THIRD PARTY) WITH REGARD TO YOUR THESE TERMS, AND/OR RIGHTS OF PRIVACY AND/OR PUBLICITY, WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION UNDER THE AMERICAN ARBITRATION ASSOCIATION’S (“AAA”) RULES FOR ARBITRATION OF CONSUMER-RELATED DISPUTES AND THE FEDERAL ARBITRATION ACT. YOU AND WE HEREBY EXPRESSLY WAIVE TRIAL BY JURY. THE FOREGOING SHALL NOT PROHIBIT THE PARTIES FROM SEEKING INJUNCTIVE RELIEF IN ANY COURT OF COMPETENT JURISDICTION.

The Arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of these Terms. You agree that each of us may bring claims against the other only on an individual basis and not as part of any purported class or representative action or proceeding. The arbitrator shall not conduct any form of class or collective arbitration nor join or consolidate claims by or for individuals and may not otherwise preside over any form of a consolidated, representative of class proceeding. Judgment on the award rendered by the arbitrator may be entered in any court having competent jurisdiction.

 

Governing law/severability

These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, excluding its conflicts of law rules, and the United States of America. If any portion of these Terms of Use is unlawful, void or unenforceable, it shall not affect the validity or enforceability of any other provision.
